These General Terms and Conditions apply to all purchases of products and services offered by Manufacture des Montres Niton SA, Geneva, Switzerland (“Niton”, “we”, “us”) via https://niton.swiss or through direct written agreement.
By placing an order, the customer agrees to these General Terms and Conditions. Individual written agreements shall prevail in case of conflict.
Product listings on the Website constitute a non-binding invitation to submit an offer. A binding contract is formed only when Niton confirms the order in writing, including by email, or dispatches the goods.
Niton reserves the right to refuse orders without providing reasons.
All product descriptions, images, and specifications are provided for informational purposes. Minor deviations in color may occur.
All products are subject to availability. In the event of unavailability after order confirmation, Niton may offer an alternative product or cancel the order and refund payments made.
All prices are stated in Swiss Francs (CHF), unless otherwise indicated.
Prices do not include VAT and exclude shipping costs, insurance, customs duties, and import taxes for international deliveries. Such additional charges are borne by the customer.
The applicable price is the one published at the time of order confirmation.
Payment may be made via bank transfer, credit card or other payment methods indicated on the Website.
Unless otherwise agreed in writing, payment is due in full at the time of order. For pre-orders or custom pieces, a deposit may be required, with the remaining balance due prior to delivery.
Niton reserves the right to withhold delivery until full payment has been received.
Delivery is available within Switzerland and internationally, subject to legal restrictions.
Delivery times are estimates and non-binding unless expressly confirmed in writing. Delays caused by force majeure, supply chain disruptions, customs procedures, or events beyond Niton’s control do not entitle the customer to damages.
For deliveries within Switzerland, risk transfers upon delivery to the customer. For international shipments, risk transfers upon handover to the carrier, unless mandatory law provides otherwise.
Under Swiss law, there is no automatic statutory right of withdrawal for online purchases unless expressly granted.
Niton may voluntarily accept returns within fourteen days of receipt, provided the product is unused, unworn, and returned in its original packaging. Return shipping costs are borne by the customer.
Customized, engraved, or made-to-order watches are excluded from return or cancellation rights.
Refunds are processed within forty five days after receipt and inspection of returned goods and are made using the original payment method unless otherwise agreed.
Niton provides warranty in accordance with Articles 197 et seq. of the Swiss Code of Obligations.
The warranty period is five years from delivery for manufacturing defects, unless otherwise stated in writing.
The warranty does not cover normal wear and tear, damage caused by misuse, accidental damage, unauthorized repairs, or modifications.
Warranty claims must be submitted in writing with proof of purchase.
To the extent permitted by Swiss law, Niton shall be liable only for damages caused by unlawful intent or gross negligence.
Liability for slight negligence is excluded except where mandatory law provides otherwise. Niton shall not be liable for indirect or consequential damages, including loss of profit or reputational damage.
Nothing in these terms excludes liability where exclusion is not legally permissible.
Niton shall not be liable for failure or delay in performance due to events beyond its reasonable control, including natural disasters, war, strikes, governmental actions, or supply chain interruptions.
All goods remain the property of Manufacture des Montres Niton SA until full payment has been received.
Niton reserves the right to register retention of title in accordance with Swiss law.
All intellectual property rights related to products, branding, designs, and Website content remain exclusively with Manufacture des Montres Niton SA.
No reproduction, distribution, or commercial use is permitted without prior written consent.
Personal data is processed in accordance with the Swiss Federal Act on Data Protection and, where applicable, the EU General Data Protection Regulation.

If any provision of these General Terms and Conditions is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These General Terms and Conditions shall be governed by and construed in accordance with the laws of Switzerland, excluding conflict-of-law principles and excluding the United Nations Convention on Contracts for the International Sale of Goods.
The exclusive place of jurisdiction for all disputes shall be the competent courts of Geneva, Switzerland, subject to mandatory consumer protection provisions.
